Community Dispute Mediation by the Community Justice Center in Sai Thai Sub-district, Mueang Krabi District, Krabi Province

Abstract
This research aims to study 1) the problems in the community dispute mediation process of the Community Justice Center in Sai Thai Sub-district, Mueang Krabi District, Krabi Province 2) Analyze factors affecting success or failure, and propose guidelines for developing community dispute mediation. This qualitative research employs documentary analysis, content analysis, and participant observation methods. Data were collected from academic documents, laws, policies, and research related to community justice centers, including information about dispute resolution processes and their impacts in Sai Thai Sub-district.
The research findings reveal that 1) community dispute mediation at the Sai Thai Sub-district Community Justice Center faces four main problems structural and operational mechanism issues where the Community Justice Center is not a primary mission; mediator capacity problems including lack of knowledge and experience; access to justice issues due to insufficient public relations; and contextual problems in Sai Thai Sub-district relating to cultural diversity and tourism-related conflicts. 2)Success factors include personal factors, procedural factors, socio-cultural factors, and legal and policy factors.
The researcher proposes development guidelines as follows: developing mediator capacity through systematic training and mentoring systems; developing a 5-step mediation process suitable for local contexts; developing diverse service access channels; creating community participation through justice volunteer networks; integrating religious principles and local customs; and developing database and information management systems. Additionally, amendments to the Mediation Act B.E. 2562 should be considered to accommodate cultural diversity integration, online mediation, and systematic follow-up procedures.
