The Doctrine of Forfeiture (Verwirkung) in the Basketball Judicial Proceedings

Abstract

This paper focuses on the doctrine of verwirkung (forfeiture) in the basketball judicial proceedings, by analysing the concept of this doctrine applied by the Basketball Arbitral Tribunal (BAT) and the judicial decisions from previous cases. The paper reveals that when legal challenges occur in the basketball arbitral tribunal process, the BAT frequently makes the application of this doctrine within the doctrine of ex aequo et bono (from equity and conscience) and the principle of the good faith (bona fide). This means creditors (i.e., players, coaches, or agents) might not be able to claim against a debtor (i.e., club) if creditors remain silence or inaction for an unreasonable amount of time. This paper also reviews recent important cases involving main prerequisites of the doctrine of verwirkung in the BAT jurisprudence and application of this doctrine, including BAT precedential cases. This emphasis is placed prominently on the doctrine of verwirkung to reflect the importance it assumes in practical applications of this doctrine in the BAT jurisprudence.
